Palm Beach Boutique makes this website, including all information, tools, and services available from this site, available to you, the user, conditioned upon your acceptance of all terms, conditions, and notices stated here.
By visiting our website and/or purchasing our products, you agree to our service and the following terms and conditions (“Terms of Use,” “Terms”), including all additional terms and policies referenced herein and/or available via hyperlink. The Terms of Use apply to all users of the website, including, without limitation, users who are visitors, suppliers, customers, merchants, and/or content providers.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.
Article 1 – Definitions
In these terms and conditions, the following definitions apply:

Right of withdrawal: the possibility for the consumer to withdraw from a distance contract during the withdrawal period.

Distance contract: a contract concluded as part of an organized system for distance sale using remote communication.

These Terms and Conditions are governed by the laws of the Netherlands.
Article 3 – Application
These terms of use apply to all offers made by Palm Beach Boutique and to all distance contracts and orders between the supplier and the consumer.
Before the distance contract is concluded, these terms and conditions must be made available to the consumer. If this is not possible, it will be stated that they are available for consultation and will be provided free of charge upon request.
If the distance contract is concluded electronically, the consumer must be able to store these terms on a durable medium prior to concluding the contract.
If special product or service conditions apply in addition to these terms, the most consumer-friendly provision shall prevail in the event of conflict.
If any provision of these terms is invalid or unenforceable, the remaining provisions remain in force and the invalid provision will be replaced by one reflecting the original intent as closely as possible.
Article 4 – Offer
If an offer has a limited duration or conditions, this will be clearly stated. The offer is non-binding and may be modified.
The offer contains a complete and accurate description of the products and/or services. Images are indicative and may not exactly reflect the final product. Obvious errors are not binding.
Prices include VAT unless stated otherwise. Any import duties, VAT, or other taxes imposed by authorities are the responsibility of the customer.

Article 5 – The contract
The contract is concluded when the consumer accepts the offer and meets the stated conditions.
Electronic acceptance is confirmed electronically. If confirmation is not received, the consumer may cancel the contract.
Palm Beach Boutique reserves the right to refuse orders or impose conditions if there are reasonable grounds to do so.
All contracts are subject to product availability.
Article 6 – Right of withdrawal
The consumer may withdraw from the contract within 30 days without giving any reason. This period begins the day after receipt of the product.
Products must be handled with care and returned in original condition where possible.
To exercise the right of withdrawal, the consumer must notify Palm Beach Boutique in writing or by email within 30 days.
Returned products must be shipped within 30 days of notification. Failure to do so makes the purchase final.
Article 7 – Costs in case of withdrawal
Return shipping costs are borne by the consumer. Refunds will be processed within 14 days after receipt of the returned product or proof of return.
Article 8 – Exclusion of withdrawal
The right of withdrawal does not apply to:

Customized or personalized products

Hygiene products once opened

Perishable goods

Products with price fluctuations beyond supplier control
Article 9 – Price
Prices remain unchanged during the stated offer period, except due to VAT changes or legal requirements.
All prices are subject to typographical errors. Palm Beach Boutique is not obliged to honor incorrect prices.
Article 10 – Conformity and liability
Products must conform to the contract and reasonable quality standards.
Defects must be reported within 14 days of delivery. Warranty is limited to manufacturer warranties.
Liability does not apply if products are misused, modified, or damaged by external regulations.
Article 11 – Delivery and performance
Orders are processed with care and delivered within 30 days unless otherwise agreed.
If delivery is delayed or incomplete, the consumer has the right to cancel and receive a refund.
Article 12 – Duration, termination, and extension
Consumers may terminate indefinite contracts at any time with one month’s notice.
Fixed-term contracts may not be automatically renewed unless permitted by law.
Article 13 – Payment
Payments are due immediately upon order placement using the available payment methods.
Incorrect payment details must be reported immediately.
Article 14 – Complaints
Complaints must be submitted within 7 days of discovery and will be addressed within 14 days.
Unresolved disputes may be submitted to arbitration.
Article 15 – Disputes
All agreements are governed exclusively by Dutch law.
